If the process requires a referral from a Member of Parliament (MP), what options exist for members of the public whose MP refuses to make such a referral? 3. Is there a formal route of appeal, escalation, or independent review available in the event that an MP declines to support or forward a complaint? 4. Please provide any guidance or internal documentation that outlines how the PHSO handles situations where access to its service is effectively blocked due to lack of MP support. This request relates to public accountability and transparency in access to justice. Please respond within the statutory timeframe.

I am looking to obtain some information regarding the Rivergreen Medical Centre based in Clifton Nottingham. the full address is 106 Southchurch Drive Nottingham NG11 8AD I would like to know how many complaints that have been logged against them to NHS England and also the Ombudsman ( yourselves). i would like the type of complaints , how many in total , details of the complaint and who they were complaining about at the surgery , preferably name but if that is not allowed the position held that the complaint was about. I am writing to express my dissatisfaction with the handling of my request for the following reasons: The information I have requested is in the interest of public safety. Following a fitness to practise investigation, the General Dental Council (GDC) has listed (Redacted) as a registrant with "undertakings" requiring supervision. Previous investigations have also identified instances where (Redacted) failed to follow established procedures. A 2021 inspection by the Care Quality Commission (CQC) raised serious concerns about his record-keeping. Subsequent GDC investigations have shown that prior attempts to address these issues were insufficient. These findings indicate that the misconduct is unlikely to be limited to just two cases and may instead point to systemic failings that affect all patients under his care. It is therefore vital that the information requested under the Freedom of Information Act is disclosed in the public interest. Accordingly, I respectfully request an internal review of the handling of my request and urge you to reconsider your position. I look forward to your response within 20 working days, as recommended by the Information Commissioner’s Office: “The Information Commissioner’s Office recommends that public authorities carry out internal reviews within 20 working days. Under Environmental Information Regulations there is a legal requirement that internal reviews must be carried out as soon as possible and within 40 working days.”

I am writing to express my dissatisfaction with the handling of my request for the following reasons: The information I have requested is in the interest of public safety. Following a fitness to practise investigation, the General Dental Council (GDC) Case Examiners reviewed the evidence and determined that there was a real prospect—that is, a genuine possibility—that a Practice Committee would find: • All factual allegations proven; • That these facts, if proven, would amount to misconduct; • That the registrant’s fitness to practise is currently impaired. These findings indicate that the misconduct is unlikely to be limited to a single case and may instead reflect systemic failings that affect many patients under his care. It is therefore essential that the information requested under the Freedom of Information Act is released in the public interest. Specifically, I am requesting a list of complaints made about (Redacted) at Church View Dental Clinic in Upminster, along with the context in which these complaints were submitted. This request is made for the purpose of gathering evidence in relation to a GDC Rule 9 Fitness to Practise appeal. Accordingly, I respectfully request an internal review of the handling of my request and urge you to reconsider your position. After reviewing the information provided, I would like to submit a follow-up FOI request under the Freedom of Information Act 2000 to clarify certain aspects and request additional details. 2. Complaint Outcomes & Formal Actions Taken Your response included figures for complaints upheld but did not specify the level of action taken against AJM Healthcare. Please confirm: • The number of complaints where recommendations were made to AJM Healthcare. • Whether AJM Healthcare has failed to comply with any recommendations in the past five years. • The number of repeat complaints (cases where AJM Healthcare was previously found at fault and similar issues were raised again). 3. Escalation & Enforcement Given the repeated complaints against AJM Healthcare, please provide: • Internal policies or guidance on what criteria must be met for the PHSO to escalate action against a provider for repeated failings. • Any instances where the PHSO has formally warned AJM Healthcare or escalated concerns to NHS commissioners or regulators.

Please supply all information however held detailing the PHSO’s policies, procedures and guidance to staff on the consistent and proper approach taken on the assessment of health complaints and how to determine whether an alternative legal remedy is available or suitable under Section 4 The Health Service Commissioners Act 1993 (HSCA) and/or Section 5(2) Parliamentary Commissioners Act 1967 (PCA) and or any other relevant legislation. Please note reference to the Commissioner below ordinarily refers to the ombudsman. 2. Please advise on how frequently the Commissioner reviews the application of Section 4 HSCA and Section 5(2) PCA (or any other relevant legislation) to ensure that the approach taken is current and reflects all the relevant considerations the commissioner is to be mindful of when being satisfied that it is reasonable to expect the aggrieved person to resort to litigation. 3. Please advise on whether and if so, when the Commissioner has considered the implications of the Civil Procedure Rules (CPR) which governs the conduct, practice and procedures expected of those undertaking Civil litigation with particular reference to paragraphs 3 (c) and (d) CPR https://www.justice.gov.uk/courts/procedure-rules/civil/rules/pd_pre-action_conduct#3.1: which confirms the courts expectation that parties to litigation should (c) “try to settle the issues without proceedings (d) consider a form of Alternative Dispute Resolution (ADR) to assist with settlement. 4. can I get some further clarification. Sussex Police is currently investigating deaths at University of Sussex Hospital (USH) trust in its Operation Bramber (https://mipp.police.uk/operation/4723F50-PO1) and it will be liaising with solicitors who represent patients of the hospital who have taken the cases to NHS Resolution. You are simultaneously looking at 48 cases while the Police are doing their investigation. You say that we would also not look at complaints where there was an ongoing police investigation. Do you just mean that someone who goes to NHS Resolution cannot simultaneously go to the PHSO? The BBC has also highlighted cases that do not fit into the timeframe of the Sussex police enquiry; for example, this is a case involving Mr Lamah, the lead colorectal consultant at USH which implies that there are serious management problems in USH which is also highlighted in the RCS report: https://www.bbc.co.uk/news/articles/cp31gewg02do My concern is that the Police and you will both conduct investigations into lots of separate individual cases but no one will look at the management failures going on in the hospital. The 2 consultants who initially raised these issues and were interviewed on Newsnight also raised concerns not just about patient safety and the deaths of patients but about other issues (i.e. poor management and a toxic culture) which it's unlikely that the Police would investigate. Once the Police investigation completes, will you investigate the wider issues unilaterally or do you need to be invited by someone to do an investigation? Can the local Council in Brighton or a local MP in Brighton or the bodies that oversee the NHS (DOH, NHS England, CQC) request the PHSO to investigate these other issues?
