I am writing to submit a request for information under the Freedom of Information Act 2000. I would be grateful if you could provide the following data: 1. The organisation’s monthly sickness absence rate for the period January 2025 to April 2026. 2. The organisation’s monthly turnover rate for the period January 2025 to April 2026. In addition, I would appreciate clarification on the methodologies used to calculate these figures. Specifically: • How is the sickness absence rate calculated? For example, is it determined by dividing total sickness absence hours by total contracted hours? • How is the turnover rate calculated? Is it based on a 12 month rolling period, calculated by dividing the total number of leavers in the past twelve months by the average number of employees over the same period? If alternative calculation methods are used, I would be grateful if you could outline these.

I am writing to request recorded information held by the Parliamentary and Health Service Ombudsman (PHSO). The PHSO exists to investigate complaints concerning maladministration, service failure and injustice involving Government departments and other public bodies. In that context, please provide any recorded information (including policies, guidance, procedures, governance documents, legal framework documents, memoranda, briefing documents, operational guidance or decision-making frameworks) which establishes: 1. The PHSO’s role, responsibilities or obligations when presented with credible evidence of: • fraud; • corruption; • misconduct; • maladministration; • abuse of public office; • institutional failure; or • systemic failures affecting access to justice or accountability. 2. Whether the PHSO has any legal, statutory, procedural or policy obligation to: • receive such evidence; • assess such evidence; • record such evidence; • refer such evidence to another authority; or • otherwise act upon such evidence. 3. Any recorded information identifying circumstances in which the PHSO may: • refer information to a police force; • refer information to a regulator; • refer information to another oversight body; • notify Parliament; or • produce a special report concerning systemic failings. 4. Any recorded information describing how the PHSO handles situations where: • multiple public authorities are alleged to have failed; • jurisdiction is disputed between public bodies; • a complainant alleges systemic institutional failure; • a complainant alleges that no authority is willing to receive or investigate evidence presented. 5. linked to: 00004500 I request an internal review of your decision to refuse my Freedom of Information request under section 12(1) of the Freedom of Information Act 2000. 1. You applied section 12 without demonstrating a reasonable search strategy You state that you “do not hold any searchable components” for complaints relating to the inability to accommodate physical disabilities during x rays or mammograms. You then state that you would need to examine all cases manually at an estimated five minutes per case. You rely on this estimate to claim that the request exceeds the appropriate limit. I challenge this position because you have not demonstrated that you applied a reasonable or proportionate search strategy. The ICO’s guidance on section 12 requires public authorities to identify and explain the specific steps they would need to take, the datasets they would need to search, and the basis for any time estimates. You have not provided this detail. You have not explained why you cannot search by disability related keywords, access needs, reasonable adjustments, imaging procedures, or any other structured complaint categories that your case management system should contain. 2. You did not consider whether partial information falls within scope You state that you “would be able to look at some Trusts from the region, but not all”, and you list combinations of trusts that fall within the time limit. This statement confirms that you hold relevant information and that you can extract it for at least part of the request. Section 16 requires you to advise and assist requesters. You did not offer to provide the information you can retrieve within the limit. You instead presented the combinations as hypothetical examples rather than as a concrete offer to disclose partial data. You therefore failed to comply with your duty under section 16. 3. You did not consider narrowing the request in a way which preserves its purpose The purpose of the request is to understand the scale and nature of disability related barriers in imaging services. You could have advised me to narrow the request by: • restricting the timeframe • restricting the imaging modality • restricting the disability category • restricting the complaint stage (enquiries, assessments, investigations) • restricting the search to cases coded under reasonable adjustments or accessibility You did not propose any of these options. You instead relied on a blanket assertion that the work would exceed 18 hours. 4. You incorrectly refused the final two questions You state that you “cannot create information (such as opinion)”. I did not ask you to create information. I asked for your recorded assessment of how NHS providers implement their duty to make reasonable adjustments, and for your recorded view on whether inaccessible equipment or staff attitude contributes to the issue. If you hold no recorded assessment, you must state this clearly under section 1(1)(a). You did not do so. You instead relied on a general statement about not creating information. This approach does not meet the requirements of the Act. 5. You did not confirm whether you hold any relevant policy, thematic analysis or learning reports The PHSO routinely produces thematic reports, learning summaries, and internal analyses on accessibility, equality, and reasonable adjustments. You did not confirm whether you hold any such material that relates to disability and diagnostic imaging. You must confirm or deny whether you hold such information unless an exemption applies. 6. You did not consider whether you could extract data using sampling ICO guidance confirms that authorities may use sampling to determine whether a request exceeds the cost limit. You did not explain whether you sampled cases, whether you tested your five minute estimate, or whether you considered whether a narrower sample could produce meaningful data within the limit. Request for remedy I ask you to: 1. Reconsider the application of section 12(1) in line with ICO guidance. 2. Provide the information you can retrieve within the cost limit. 3. Confirm whether you hold any recorded assessments, thematic reports, or internal analyses relevant to reasonable adjustments in imaging services. 4. Confirm whether you hold any recorded information relating to the contribution of inaccessible equipment or staff attitude. 5. Provide meaningful advice and assistance under section 16 to help me refine the request without undermining its purpose. I look forward to your full internal review outcome. In the meantime, you stated: "We would be able to look at some Trusts from the region, but not all. I have listed some examples of a combination of Trusts which we could look at: • East Suffolk and North Essex NHS Foundation Trust and Cambridgeshire Community Services NHS Trust- 13 hours • Norfolk and Norwich University Hospitals NHS Foundation Trust and Cambridgeshire Community Services NHS Trust- 11 hours • Cambridge University Hospitals NHS Foundation Trust and Cambridgeshire Community Services NHS Trust- 12 hours" I am confused since you would only be able to do one of the trusts in reality under the 18-hour rule. In particular, I request please all data about WhistleblowersUK and/or the APPG requesting and/or receiving permission to use the PHSO logo on its website or promotional material circulated in Parliament and on social media. For the timespan to search, I believe it would be helpful to search from July 2018 if possible, which is when the APPG was set up but there should be some data held since 2022.
